The essentials

The data we collect

• Identity and contact details: last name, first name, email address, phone number, shipping and billing addresses.
• Orders: products purchased, configuration of your custom watch, amount, shipping method, purchase history. Payment is processed directly by our payment providers: we never see your card number.
• Communications with us: messages sent by email, WhatsApp, contact form or chat, and any attached photos or videos.
• Newsletter: your email address and your interactions with our emails (opens, clicks).
• Browsing: IP address, device and browser type, pages viewed, via cookies.

No significant decision concerning you is made solely by a computer, except for the automated fraud check carried out at the time of payment.

Who receives your data

Your data is intended for Yan Smode. It is also shared, only to the extent necessary, with our service providers:

• Shopify: our online store platform, hosting, payment (Shopify Payments), fraudulent order detection, order emails, newsletter, forms and chat;
• payment: PayPal, Klarna, Apple Pay and Shop Pay, depending on the payment method chosen;
• shipping: La Poste (Colissimo) or Mondial Relay, depending on the shipping method chosen;
• Kickflip: our custom watch configurator;
• Google (Google Analytics, Google Ads, Google Tag Manager): traffic measurement and advertising, only if you agree.

We may also disclose your data to the authorities when required by law. We never sell or rent your data.

Transfers outside the European Union

Some providers, including Shopify and Google, may process your data outside the European Union, in particular in Canada and the United States. These transfers are permitted and protected by the safeguards provided for by the GDPR (European Commission decisions or standard contractual clauses).

Cookies

A cookie is a small file placed on your device when you visit the website. We use:

• necessary cookies for the website to work (cart, payment, security, remembering your choices): they do not require your consent;
• analytics and preference cookies (including Google Analytics), to understand how the website is used and improve it;
• advertising cookies (Google Ads, Google Tag Manager), to measure the effectiveness of our ads and show you relevant ads.

Analytics and advertising cookies are only placed after you give your consent, through the banner shown on your first visit. You can accept, refuse or customize your choices, and change them at any time using the “Manage my cookies” link at the bottom of the page. Refusing these cookies does not prevent you from using the website or placing an order.

Your rights

At any time, you can access your data, correct it, delete it (except data the law requires us to keep, such as invoices), restrict its use, obtain a copy of it, object to its use (in particular for marketing) or withdraw your consent (newsletter, cookies). You can also set instructions regarding what happens to your data after your death.

Security

The website is fully secure (HTTPS) and payments are encrypted: we never have access to your bank details. Access to your data is limited to the people who need it.

We may update this policy, for example if we start using a new service provider. The version that applies is always the one displayed on this page.
